The Klicks – Terms and Conditions
- The Klicks or “Awards” are organised by Klaviyo Ltd, a group company of Klaviyo, Inc. (collectively, “the Organiser”) with its address at 49 Southwark Bridge Road, London, SE1 9HH, UK.
- In submitting an entry for the Awards, entrants will be deemed to have read, understood and agree to be bound by these terms and conditions.
- In submitting an entry for the Awards, entrants agree to allow the details of their entry to be shared with the judges and representatives of the Organiser. All entrants will be deemed to have consented to the transfer and sharing of their company, campaign and marketing data and information for the purposes of administration and judging of the Awards. Any financial information provided as part of the entry will be converted to percentages. The Organiser will only process your personal information as set out here (see also sections 11 and 12 re announcement of the winners).
- In submitting an entry for the Awards, entrants agree to Organiser using the entry information as a case study for the Klaviyo platform. The specifics of such case study shall be agreed between the parties and will be subject to separate terms and conditions.
- The Klicks are open to brands that use the Klaviyo platform in respect of their marketing campaign(s) or activity(ies) in the Europe, Middle East and Africa region(s) and where such campaign(s) or activity(ies) took place between 1 January 2023 to 30 June 2024.
- All entries must be received by the Organiser no later than 11:59pm on 1st July 2024. Entries received after the submission deadline will not be accepted. Organiser will not accept responsibility or liability for any lost, late, or incomplete entries with all such entries deemed invalid.
- All category entries must be submitted in English and submitted via email with supporting documents (if applicable) using the ‘Entry Form’.
- Where an entry is submitted by a partner or other third party representative on behalf of a brand/ company, the brand/ company must also explicitly sign the ‘Entry Form’ to agree to; i) the submission of the entry and ii) these terms and conditions.
- Entrants may enter multiple award categories, however, all submitted entries must be tailored for each individual category.
- All category finalists will be notified via-email no later than 1st September 2024.
- The judges will shortlist up to three (3) finalists from each award category and the finalists will be publicly announced on 30th September 2024. Finalists will also be listed on the Organiser’s social media channels and other marketing materials related to the Klicks.
- Award winners will be announced during the awards ceremony taking place in London on 7th November 2024. Under no circumstances will the details of winners be disclosed prior to the event.
- All category finalists are required to be present at the awards ceremony and each finalist will be provided with up to 10 complimentary tickets.
- The judges and Organiser reserve the right at their absolute discretion to amend category selections where it is deemed appropriate or to reject any entry without explanation or notice.
- The judges’ decision will be final and no explanation, correspondence or discussion will be offered or entered into before or following the judges’ decision.
- The Organiser reserves the right at its sole discretion to alter or reschedule the Awards, the awards ceremony and / or these terms at any time and without notice.
- The Organiser will not be liable for any death, injury, financial loss or damage sustained by an Award attendee as a result of, or arising from any circumstances, including but not limited to financial losses arising from the rescheduling or the cancellation of the awards ceremony.
- Prior to and following the Awards, the Organiser will produce a comprehensive publicity campaign highlighting the Awards, Award categories, winners, runners-up and finalists. All award entrants, winners, and finalists agree to offer Organiser the exclusive right to use content, images and film for the promotion of the Awards without any further notice, review, consent, compensation, or remuneration.
- Photography and filming by Organiser’s approved photographers and film crews will take place during the awards ceremony. As photographs and film footage may include images of award winners, finalists and attendees; all award winners, finalists and attendees acknowledge and accept that the Organiser may record, photograph, film and broadcast (via print, electronic means and internet) any image or film footage taken during the awards ceremony. All winners, finalists and attendees agree that the Organiser shall have the exclusive right to use any image or film footage taken during the awards ceremony for the promotion of the Awards, and otherwise for Organiser’s commercial purposes without any further notice, review, consent, compensation, or remuneration.
- All award entrants, winners, runners-up and finalists grant Organiser the exclusive right to use and reproduce their name, trademark and company logo for pre-event, onsite and post-event marketing of the Awards without any further notice, review, consent, compensation, or remuneration.
- By submitting an entry for the Awards, entrants consent to Organiser contacting them via email and telephone with regards to the Awards.
- These terms and conditions shall be governed by the laws of England and Wales and the courts of England and Wales shall have exclusive jurisdiction.
